Our Terms & ConditionsClear. Transparent. Built with Trust.

OSHIYANA – Where Heritage Finds Its Home is a brand dedicated to Indian drapes, sarees, textiles and related products.

The website is operated by the legal entity or business owner identified in the website's official business and contact information. The exact legal name, business address, GST details, customer-support details and grievance-officer details, wherever applicable, will be displayed on the website as required by applicable law.

By accessing, browsing, registering on, or purchasing from the OSHIYANA website, you acknowledge that you have read and understood these Terms & Conditions and agree to be bound by them, together with the applicable Privacy Policy, Shipping & Delivery Policy, Cancellation Policy, Refund & Replacement Policy and other applicable product or promotional terms.

If you do not agree with these Terms & Conditions, please do not use the website or place an order.

The website is intended primarily for persons legally capable of entering into contracts under applicable Indian law.

If a person below the legally applicable age accesses or uses the website, such use should be under the supervision and responsibility of their parent or legal guardian.

Where an order is placed by a person on behalf of another individual or organisation, that person represents that they have the authority to do so.

You agree to use the website only for lawful purposes and in accordance with these Terms.

You must not attempt to gain unauthorised access to the website or its systems; interfere with website security; introduce viruses, malicious code or harmful software; scrape or systematically copy website content without permission; impersonate another person; provide false or misleading information; use the website to commit fraud; or interfere with another customer's use of the website.

Unauthorised or unlawful use may result in restriction of access and/or appropriate action in accordance with applicable law.

Certain website functions may require an account or customer information. You are responsible for ensuring that information provided by you is accurate and up to date.

You should maintain the confidentiality of your account credentials and notify OSHIYANA promptly if you believe that your account has been compromised.

OSHIYANA may take reasonable steps to protect customer accounts and may suspend or restrict an account where there is evidence of misuse, fraud, security compromise or violation of these Terms, subject to applicable law.

OSHIYANA makes reasonable efforts to ensure that product information displayed on the website is accurate and useful. Product information may include photographs, fabric details, colour, dimensions, weaving details, zari details, product descriptions, product codes, care instructions, price and availability.

Slight differences may occur because of photography, lighting, screen settings and the natural characteristics of textiles. For handcrafted and handwoven products, minor variations in weave, texture, zari, motif placement and finish may naturally occur and will not automatically constitute a defect.

Products displayed on the website are subject to availability. Display of a product does not guarantee that it will remain available until checkout or dispatch.

If an ordered product becomes unavailable before dispatch, OSHIYANA may contact the customer regarding available options, including cancellation and applicable refund.

Prices displayed on the website are stated in Indian Rupees unless otherwise specified. Applicable taxes, shipping charges or other charges, if any, will be displayed or communicated as applicable to the transaction.

OSHIYANA takes reasonable care to display accurate prices. In the event of an obvious technical, typographical or pricing error, OSHIYANA may review the order before dispatch and take an appropriate course of action permitted by applicable law. If payment has already been received for an order that OSHIYANA cannot fulfil because of such an error, the applicable amount will be refunded in accordance with the applicable refund process.

OSHIYANA may provide discounts, promotional offers, seasonal sales, coupon codes, bundle offers, clearance offers, limited-period offers or other promotional benefits.

Each offer may have specific terms, eligibility requirements and validity periods. The applicable offer terms will be communicated at the relevant point of purchase. Unless expressly stated otherwise, offers cannot be combined.

OSHIYANA may withdraw or modify an offer in accordance with its stated terms and applicable law. Promotional pricing does not by itself remove any mandatory consumer rights available under applicable law.

When you place an order, you are submitting a request to purchase the selected product(s) at the displayed price and under the applicable terms.

An order acknowledgement may be sent after the order is received. Order acceptance, processing and dispatch may be subject to product availability, payment verification, fraud or security checks and other applicable conditions.

An order confirmation does not necessarily guarantee dispatch if a legitimate issue arises before fulfilment.

Orders may be cancelled where permitted by the order status and applicable Cancellation Policy.

Cancellation may not be possible after an order has entered certain stages of processing, dispatch, customisation or production, except where applicable law requires otherwise.

OSHIYANA may provide payment options such as UPI, debit cards, credit cards, net banking, wallets, Cash on Delivery where available, or other payment methods made available through authorised payment providers.

Payments may be processed through third-party payment gateways. OSHIYANA does not directly store sensitive payment credentials such as card PINs. Customers must ensure that the payment information provided is accurate and that they are authorised to use the selected payment method.

Cash on Delivery may be available only for selected locations, products, order values or customers.

OSHIYANA may restrict COD availability where permitted by its operational or fraud-prevention procedures. Any applicable COD charges will be communicated before order completion.

OSHIYANA will make reasonable efforts to dispatch and deliver orders within the estimated timeline communicated to the customer.

Delivery timelines may vary depending on destination, logistics partner, weather, public holidays, operational conditions, remote-area serviceability or circumstances outside OSHIYANA's reasonable control.

Estimated delivery dates are not necessarily guaranteed delivery dates unless expressly stated otherwise. Detailed provisions are contained in the Shipping & Delivery Policy.

Customers are responsible for providing a complete and accurate delivery address and contact information.

OSHIYANA will not be responsible for delays or failed delivery caused by an incorrect or incomplete address, incorrect phone number, recipient unavailability, refusal to accept delivery or other information supplied incorrectly by the customer, subject to applicable law.

Customers are encouraged to check the outer package and product condition promptly after delivery.

For damaged, defective or incorrect products, customers should follow the reporting procedure provided in the Refund & Replacement Policy.

All returns, replacements and refunds are governed by OSHIYANA's separate OUR REFUND & REPLACEMENT POLICY. That policy forms part of these Terms & Conditions.

Customers should carefully review the Refund & Replacement Policy before placing an order. Where a product-specific or promotional return condition conflicts with a mandatory consumer right, applicable law shall prevail to the extent of that conflict.

OSHIYANA may offer products involving traditional Indian craftsmanship and textile processes. Natural characteristics may include minor variations in weave, texture, zari, thread, colour, motif placement, finishing or other handcrafted details.

These characteristics may vary from one piece to another and contribute to the individual character of the product. OSHIYANA will not use this clause to classify a genuine material defect, wrong product or materially misrepresented product as merely a handcrafted variation.

All intellectual property appearing on the OSHIYANA website, including the OSHIYANA name, logo, brand marks, slogans, photographs, product images, videos, graphics, illustrations, website design, layouts, written content, product descriptions, icons, decorative elements and other original content, is owned by, licensed to, or otherwise lawfully used by OSHIYANA unless specifically stated otherwise.

Nothing on this website grants you ownership of OSHIYANA's intellectual property. Reproduction, copying, modification, distribution, commercial exploitation or unauthorised use of OSHIYANA content is prohibited without prior written permission.

The OSHIYANA name, logo, visual identity and associated brand elements are protected intellectual property of the brand and/or their respective rights holders.

You may not copy the OSHIYANA logo, reproduce it commercially, modify it deceptively, use it to create confusion with OSHIYANA, represent yourself as OSHIYANA, or use OSHIYANA's identity for an unauthorised business activity.

Where the website permits customers to submit reviews, photographs, comments, testimonials, feedback or other content, you must ensure that such content is lawful and does not infringe another person's rights, contain malware, contain unlawful or threatening material, contain defamatory or obscene material, violate privacy, impersonate another person or contain misleading information.

OSHIYANA may moderate or remove content that violates applicable law or these Terms.

Feedback, suggestions or ideas voluntarily submitted by customers may be used by OSHIYANA for improving its products, services or customer experience, subject to applicable law and the customer's rights.

Ordinary customer feedback will not be treated as transferring ownership of unrelated intellectual property belonging to the customer unless separately agreed.

The website may use third-party services including payment gateways, logistics providers, analytics services, communication services, hosting providers, authentication services or other technology providers.

Such services may be governed by their own terms and privacy policies. OSHIYANA will use reasonable care in selecting and working with service providers but cannot guarantee uninterrupted operation of every third-party service.

The OSHIYANA website may contain links to third-party websites or services. Such links may be provided for convenience or information.

OSHIYANA does not automatically endorse or assume responsibility for the content, availability, security or policies of third-party websites. Customers should review the terms and privacy policies of third-party websites before using them.

OSHIYANA aims to maintain a reliable website experience. However, the website may occasionally become unavailable because of maintenance, upgrades, technical problems, server issues, internet or network interruptions, cybersecurity incidents or circumstances outside OSHIYANA's reasonable control.

OSHIYANA does not guarantee uninterrupted or error-free website availability at all times.

You must not use the website to commit fraud, conduct unlawful activity, interfere with website security, attempt unauthorised access, distribute malicious software, scrape protected content without permission, manipulate offers or promotions fraudulently, create multiple accounts for abuse of promotional benefits, place fraudulent orders, submit knowingly false complaints or otherwise misuse OSHIYANA services.

OSHIYANA may take appropriate action where misuse is identified, subject to applicable law.

OSHIYANA may conduct reasonable verification procedures for orders where necessary to protect customers and the business against fraud. This may include verification of customer information, contact details, payment information through authorised payment providers, order history, delivery details or unusual order activity.

Where a transaction presents a legitimate security or fraud concern, OSHIYANA may delay, decline or cancel the transaction as permitted by applicable law.

Your use of the OSHIYANA website is also governed by the OSHIYANA Privacy Policy. The Privacy Policy explains how OSHIYANA collects, uses, stores and processes personal information.

Customers should review the Privacy Policy before using services requiring personal information.

To the maximum extent permitted by applicable law, OSHIYANA shall not be responsible for indirect, incidental, special or consequential losses arising solely from circumstances beyond OSHIYANA's reasonable control.

Nothing in these Terms is intended to exclude or restrict liability that cannot legally be excluded or restricted under applicable law. Nothing in these Terms shall remove or reduce any mandatory consumer protection right available under applicable law.

OSHIYANA shall not be responsible for delays or failure to perform an obligation where such delay or failure results from circumstances reasonably beyond its control, including where applicable natural disasters, floods, fire, severe weather, war, civil disturbances, government restrictions, strikes, widespread transportation disruption, major technology or network failures, epidemics or pandemics, or other comparable events.

OSHIYANA will make reasonable efforts to resume affected services when circumstances permit.

OSHIYANA may restrict or suspend access to the website or customer account where reasonably necessary because of fraud, unlawful activity, security concerns, abuse of the platform, violation of these Terms or other legitimate reasons.

Any pending customer obligations or rights that have already accrued will not automatically disappear merely because access to the website is suspended.

To the extent permitted by applicable law, a user may be responsible for losses reasonably arising from their unlawful actions, fraudulent activity, intentional misuse of the website, infringement of third-party rights or material breach of these Terms.

Nothing in this clause shall require a customer to indemnify OSHIYANA for liabilities caused by OSHIYANA's own unlawful conduct or liabilities that cannot legally be transferred to the customer.

OSHIYANA may update these Terms from time to time to reflect changes in law, regulatory requirements, business operations, website functionality, products or services, security requirements or other legitimate business needs.

The updated version will be published on the website with an updated date. For existing orders, the terms applicable to the transaction will be determined in accordance with applicable law and the circumstances of that transaction.

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a competent authority, that provision shall be interpreted or modified to the extent legally permissible, and the remaining provisions shall continue to operate to the extent permitted by law.

If OSHIYANA does not immediately enforce a particular provision of these Terms, that does not automatically mean that OSHIYANA has permanently waived its right to enforce that provision later, subject to applicable law.

These Terms, together with the applicable Privacy Policy, Refund & Replacement Policy, Shipping & Delivery Policy, Cancellation Policy, Offer Terms and other product-specific terms, form the applicable contractual framework governing the customer's use of the website and purchase, subject to applicable law.

These Terms shall be governed by the applicable laws of India.

Nothing in these Terms prevents a consumer from exercising any mandatory right or remedy available under applicable consumer-protection law.

Any dispute may be addressed through OSHIYANA's applicable grievance or customer-support mechanism first where appropriate, without prejudice to the customer's statutory rights. Any specific jurisdiction clause should be finalised after confirming OSHIYANA's actual legal entity and principal place of business.

OSHIYANA will provide the applicable customer-support and grievance-redressal contact information on its website.

The website should clearly identify the relevant Grievance Officer or customer-support contact, together with the applicable contact details, designation and other information required under the prevailing e-commerce framework.

Complaints will be acknowledged and addressed within the timelines required under applicable law and the applicable e-commerce framework.

For order-related assistance, customers may contact OSHIYANA through the official contact methods displayed on the website.

Customers should provide their order number, registered mobile or email, product code where applicable and relevant details of the issue to enable faster resolution.

By using the website or placing an order, you consent to receiving transaction-related communications electronically through appropriate channels, which may include email, SMS, WhatsApp, telephone, website notifications or other communication methods made available by OSHIYANA.

These communications may include order confirmation, payment confirmation, dispatch updates, delivery updates, cancellation, refund, customer-support communications, security alerts and other transaction-related information.
